What are the time limits for CTP Claims?
The time limit for CTP claims is 28 days from the day of the accident. Ensure you submit the Personal Injury Benefits form to the CTP insurer within this time if you want to be considered for the weekly income payments.
You can still make a claim within 3 months of the accident occuring. Keep in mind that claims submitted much later are paid from the date of submission, not from the date of being incapacitated from the accident.
Can I still make a CTP Claim if I’m not insured?
All vehicles in NSW are required to have a CTP insurance cover, also known as a ‘Green Slip’. This insurance covers claims for compensation for people injured in a motor vehicle accident, including drivers, passengers, pedestrians, cyclists, and motorcyclists.
This means that you’re not eligible for compensation under the NSW CTP Scheme if your vehicle isn’t insured.
Who pays me the car accident compensation?
A CTP insurance company makes CTP insurance compensations to the injured victims.
What if I disagree with the CTP insurers' decision?
You can request an internal review with the CTP insurer if you don’t agree with their decision on your CTP claim. This request should be completed within 28 days of receiving the insurer’s decision.
If you proceed with the process and still disagree with the decision at the internal review, you can also make an application to the Personal Injury Commission to get a further independent review.

How long after a car accident can you claim compensation in Australia?
To receive Statutory Benefits you must submit a claim within 28 days of your accident. As stated by SIRA, you have until 3 months after the crash to submit a claim, but it is advised that you submit your claim as soon as possible.
If the claim is submitted after 28 days, you may need to explain your delay to the CTP insurer.
Can I make a CTP Claim even if I am at fault?
According to the Motor Accident Injuries Act 2017, for the first 52 weeks, it doesn’t matter who caused the accident. This means that drivers who are at fault are still eligible to receive compensation for the first 52 weeks.
Once the 52 weeks have passed, then statutory benefits to the driver will cease. This ensures that everyone involved in the car accident is supported. So if you are at fault, be sure to still reach out to us to lodge a claim as you may still be eligible for benefits.
Keep in mind that if you are at fault and your vehicle is not insured and you know that the vehicle was uninsured, then you are NOT eligible for compensation.
