In NSW, there are no legal costs payable for injured workers who make a Workers Compensation Claim. These legal costs are covered by the Independent Review Officer (IRO), a NSW Government body that is set up to fund workers compensation claims.

The answer is not always straightforward, as there are several factors that determine the timeline for compensation under NSW workers compensation legislation.

However in most cases, the insurer will have 14 days to let you know the decision of the claim. This means within 14 days you can start to receive your entitlements under workers compensation such as weekly payments, medical & rehabilitation expenses, and lump sum compensation in cases where permanent impairment is applicable.

It’s important to remember that a rejection is not the end of the road. In fact, it’s quite common for initial claims to be denied. There are a number of reasons why this may occur, such as incomplete or incorrect paperwork or insufficient evidence to support your claim.

Under Section 78 of the Workers Compensation Act, it requires that the insurer must give notice to the injured worker as to why the claim has been declined. You can provide this notice to our skilled Workers Compensation Lawyers and we’ll help you dispute the notice.

Our experts in workers compensation law will review the rejection and assess the reasons behind it. From there, we will help you gather the missing evidence and build a strong case for your appeal. Our team will guide you through the legal process and keep you up to date every step of the way.

If you’ve been injured at work due to your employer’s negligence, you may be entitled to lump sum compensation under a common law claim for Work Injury Damages, the lump sum compensation is to compensate for medical expenses, lost wages, and other damages. It’s important to note that there is a time limit for bringing a lawsuit against your employer, which is typically within three years of the occurrence of the injury.

However, there are certain circumstances where this time period can be extended, such as if the injury was not immediately apparent or if the worker was mentally incapacitated due to the injury.

The amount of compensation an injured worker can receive varies depending on the severity of the injury, their pre-injury income, and their age. There are different compensation benefits available, including weekly payments, lump sum payments, and compensation for work injury damages as a result of employer negligence.

In New South Wayes, the maximum weekly compensation payments between April and September 2023 is $2,395.30 or $622,778 over 5 years.

Lump sum payments, on the other hand, are one-time payments made to workers who have suffered a permanent impairment or injury. The maximum compensation for lump sum compensation is $665,260.
