What Happens Once A Workers Compensation Claim Has Been Lodged?

worker compensation entitlements

If you are injured at work, the first step in claiming a workers compensation is to notify your employer of the injury that you have sustained. You may also notify your employerโ€™s workers compensation insurer as well.

The notification of injury can be submitted via Icareโ€™s online portal or by email or by phone. The notifications can be given to the insurer by the worker or the employer or by some other person on behalf of the worker, for example, the workerโ€™s lawyers, doctors, colleagues, families and so forth.

After the insurer has been notified of the injury, they will contact you to discuss the support available and provide you with a claim number. The benefits you are generally entitled to while on workers compensation include weekly payments for loss of earnings, medical treatment expenses. A lump sum compensation for permanent impairment is available after your injuries have stabilised. Usually, 12 months from date of accident.

The relevant workers compensation insurer is obliged to start provisional payments within 7 calendar days unless there is a reasonable excuse not to. So, if the insurer has not issued you a reasonable excuse notice, you can expect to start receiving provisional weekly payments within 7 days.

If the insurer has issued a reasonable excuse within the 7 days, you then need to complete a claim form. They will explain in the notice as why provisional weekly payments has been delayed and include the details of the reasonable excuse they have applied. A claim form normally comes together with their reasonable excuse notice for you to complete and return, and you will also be advised how to make a claim.

One of the most common reasonable excuses is that they have not received sufficient medical information. If this happens, you just need to provide them with your medical documents such as a workers compensation certificate of capacity or other medical records which can show that a work-related injury has occurred.

There are also other reasonable excuses the insurer is allowed to use for not starting provisional weekly payments. You can find more details of the reasonable excuses through the following link: https://www.sira.nsw.gov.au/workers-compensation-claims-guide/legislation-and-regulatory-instruments/guidelines/workers-compensation-guidelines#part-1

worker compensation entitlements

However, please be aware that a reasonable excuse may apply to provisional weekly payments but not to medical payments. What this means is that upon receipt of the injury notifications, the insurer might be able to delay started paying weekly payments by applying reasonable excuses in certain circumstances, but they cannot delay paying for medical and hospital expenses. Once the notification of injury is received by the insurer, they are required to pay up to $10,000 for medical expenses until they make a formal determination on liability of claims.

Once the completed and duly signed claim form is received by the insurer, they have 21 days to either accept provisional liability for weekly payment for up to 12 weeks, or accept liability, or dispute liability.

If the insurer has accepted your claim for weekly payments, they will advise you of your weekly payment amount that you are entitled to. The weekly compensation is a form of insurance and not a wage, and as such the amount does not exactly equate to your pre-injury weekly earnings. The weekly benefits are normally paid at 95% of your pre-injury average weekly earnings (PIAWE) for the first 13 weeks and thereafter at 80% of PIAWE.

If your claim is disputed, you should consider seeking legal advice and assistance. At Alliance Compensation and Litigation Lawyers, we have assisted many injured workers in overturning declined claims at no costs to you. All our fees will be paid by the Independent Review Office (IRO).
